Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. External Content

Our Service allows you to externally post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content").

2. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by SmartMixer.

SmartMixer has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that SmartMixer shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

3. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

4. Service Description

The main purpose of our Service is to protect cryptocurrency transactions and wallets from identification. Through the mixing of funds of other users, investors and SmartMixer-owned funds, our clients will receive clean, untraceable funds back. Our clients can expect the highest form of privacy when using our service.

SmartMixer is not a collective investment scheme and does not offer securities. To use our service there is no registration needed, nor the authorisation of monetary or governmental authorities. SmartMixer’s main goal is the transmitting of highly anonymous user experience and usage of cryptocurrencies.

While using high-developed mixing technologies, SmartMixer can proudly mention that no ChainAnalysis company can analyse cryptocurrency transactions, nor find our original sources of funds after using our service. Our systems are always up-to-date, leading to an unattainability of any analytical company. SmartMixer will do its best, lifetime, to deliver a simple, safe and private usage of this service.

5. Service Availability

The Service of SmartMixer is available 24 hours a week, 365 days a year. However, sometimes updates are mandatory to always deliver a simple, safe and private user experience, or to improve our service for our clients. Updates could lead to an interruption of up to 24 hours.

6. Service Fees

In order to use our service, a small fee will be requested. The service fee ranges between 1-5% depending on which of our three pools (Standard Pool, Smart Pool, Stealth Pool) the user chooses. This will be deducted from the transacted amount that is mixed by SmartMixer’s service. The service fee is selected by the user before every mixing operation.

7. Personal Information

SmartMixer does not keep any logs. HTTP access logs are turned off as well as any other kind of logs such as SSH, FTP or others.

Information about created orders are fully deleted:

1. 24 hours after, if no funds arrive
2. Directly after the validation of a mixing operation
3. Or can be manually deleted by the user

For more safety and anonymity, we automatically rewrite all orders, leading to a changing of information before deletion so it is impossible to restore.

8. The relation between user and service

SmartMixer acts as an intermediary to help users get anonymous coins by sending backwards (not related to the user in past and future) transactions after getting confirmation from users transaction. We call it mixing.

All actions are done by user request. SmartMixer does not manually create any orders related to specific wallets or else.

SmartMixer is not a bank, payment system or other financial institution. Also, we do not maintain any accounts of users.

SmartMixer does not offer any exchange between cryptocurrencies and fiat currencies.

Our clients agree that SmartMixer accepts the funds in order to perform mixing operations for anonymization of finances, demand service fees and receive anonymous funds back to the desired address, submitted before the order.

Also, the client agrees that the sent funds for the mixing operation will be used in future mixing operations for other users. By using the Smart Code, which will be provided after the first mixing operation, the client can be sure to not receive his previous mixed funds back.

9. Prohibition of usage

By using the service you also agree that you are:

1. Not a person who is a resident of the United States of America, the Netherlands, Germany, its territories or possessions, any State of the United States of America or the District of Columbia
2. Not a partnership, corporation or other legal entity formed under United States law
3. Not a branch, agency or office located in the United States, Netherlands or Germany of a partnership, corporation or other legal entity formed under laws other than those of the United States, Netherlands or Germany
4. Not a trust of which any trustee is described in preceding articles: 1, 2, 3
5. No fiduciary or agent acting on behalf of or for the benefit of a person or entity described in the preceding items: 1, 2, 3, 4

You agree, that your decision to use our service was:

1. Not based, at least partly, on the information you received or communications you exchanged while you, or the person providing the information or with whom the communication was exchanged, was within the United States of America, Netherlands or Germany
2. Not made inside the United States of America, Netherlands or Germany
3. Not prompted to you from a source within the United States of America, Netherlands or Germany

User may never use the SmartMixer if his activity related to:

1. Drugs and tools specifically intended for the production of drugs, Drug paraphernalia Illegal Drugs, substances intended to mimic illegal drugs and/or other psychoactive products
2. Products/services specifically offered or intended to be used to produce drugs or to grow drug ingredients
3. Pyramid scheme selling
4. Falsified goods/replicas or infringements of intellectual property rights, including those intended to infringe such intellectual property
5. Trade in arms, ammunition, military weapons, explosive devices and firearms
6. Products/services which promote hate, violence, discrimination, terrorism, harassment or abuse
7. Escort companies/parlors for massages/sex care
8. Timeshare and Time Sharing Maintenance
9. Independent financial advisers (IFA), payday loans and unsecure loans/lines from banks regulated outside the FDIC
10. Products designed to circumvent copyright protection techniques or otherwise facilitate the unlicensed use of copyrighted materials
11. Supplying gambling services in jurisdictions where this is illegal or (where applicable) supplying the relevant jurisdiction with gambling services without a valid licence
12. Illegal products / services, or any company that offers indirect help for illegal activities
13. Fake references and other services/products encouraging disappointment (including fake IDs and government documents)
14. Spouse for the mail order and domestic matching programs
15. Social media "click farms"

If you use the SmartMixer service in breach of this Agreement and the Terms of Use, including all of the categories described above, you are fully responsible for your actions and obligations imposed by a third-party on the SmartMixer project because of your breach of this Agreement.

10. Reclaimer

If, after reading the Terms of Service, you do not understand if your funds are acceptable for our service, do not use it.

In case of a dispute, you release SmartMixer from any pretensions, grievances and penalties (actual and indirect) of any kind and existence triggering or in any way related to such disputes.

11. Guarantee

Before every mixing operation, our clients are committed to download the letter of guarantee. This helps, in case of any issues, which may occur during a mixing operation, to refund the funds sent to our address. In case of any issues, contact the SmartMixer support department via the chat option and attach the letter of guarantee. A refund is excluded without proof of the letter of guarantee.
